Course Description:

Why do Supreme Court Justices dissent, and what purpose do dissents serve? This question has different answers across eras of history. Famous dissenter Justice Ruth Bader Ginsburg said that "Dissents speak to a future age" as many eventually become majority opinions over time. Others have compared dissents to justices "baying at the moon," as expressions of vehement disagreement with the majority's views. In this era of dissents, has the Court's power been diminished or expanded by dissents? This course will explore the changing role of dissenting opinions in the Supreme Court and their significance today, especially as we examine important Constitutional decisions made on the "Shadow Docket," where many cases have dissents but no majority opinions.
